It's hard to believe but it's been almost six years since California enacted its landmark security breach statute, that led the way to 44 other states to follow suit. Interestingly, though California has always been known as the liberal lion that wags the tail, it appears that Massachusetts and Nevada have turned the statutory landscape on its head by enacting much more stricter, front-end encryption statutes. Will states move in the direction of Nevada and Massachusetts?

As a longstanding service provider to the accounting industry, LeapFILE will be attending a few related events this year, starting with the 25th Annual California Accounting & Business Show & Conference that is held on June 1st to June 2nd at LAX Hilton. The impending Federal Cybersecurity Law does NOT have to lead to greater IT security angst and costs

The Federal legislation "Cybersecurity Act of 2009" was submitted to Congress in April 2009. A link to the legislation is provided here. The most talked about and controversial piece of the legislation is the looming threat of placing in federal hands unprecedented authority over the public and private Internet.

Massachusetts’s Data Protection Law 201 CMR 17.00

Massachusetts passed a data protection law that is arguably one of the most stringent in the nation. 201 CMR 17.00 mandates that “every person who owns, licenses, stores or maintains personal information about a resident of the Commonwealth [of Massachusetts] shall be in full compliance with 201 CMR 17.00” by the deadline of January 1, 2010.

Why Email is not secure?

We’ve all heard that email is not secure.  But how and why is email insecure? 

Email is typically sent like this; the sender’s email client (e.g. Outlook) sends an email to the sender’s email server using SMTP protocol.  Then sender’s server sends the email to the recipient’s server, also using SMTP.  Then the recipient downloads the email from the recipient’s server.  

Why this isn’t secure?

CA Senate Bill 1386 – What is it about?

Effective since July 1st 2003, CA Senate Bill 1386 mandates all public or private agencies that conduct business in California to provide notification if there is a security breach to the electronic database containing personal information of any California resident. Section 2 (d) states that breach of the security of the system means “unauthorized acquisition of computerized data that compromises the security, confidentiality, or integrity of personal information maintained by the person or business”.
